Your inquiry has been researched and found that in 2012 a variance was approved for the construction of a sidewalk along the 37th Street North side adjacent to the Main Library parking lot. The explanation and justification for the variance at that time is as follows: Due to the existing conditions the installation of a public sidewalk is not feasible. Within this portion of the right-of-way there are large shade trees and existing utility poles. Further, the existing parking lot abuts the property line with no buffer, thus this portion of the right-of-way is the only green yard provided between the street curb and property line. A public sidewalk already exists north of the existing parking lot and connects to a sidewalk on the library property. The library sidewalk does lead directly to a public sidewalk in the 9th Avenue North right-of-way. Based on the criteria in the City Code for reviewing variances, staff supports the variance to waive the requirement to install a public sidewalk along 37th Street North.
