Brier Neck Ave is a private road that is being encroached upon by abutters who have both a fence and a shed in the road that is making it very difficult to use the road safely. The road is actually 20' wide, but it is now only about 8 ' wide. There are only 3 residents on the road who willfully maintain the road throughout the seasons. The abutters have no need to use the road to access their property, but merely have claimed over half of the road for their own personal property. It is virtually impossible to have two cars pass safely let alone one vehicle. It is a public hazard!!

When people start building in roads, I do hope it becomes a firelane issue. There was a devastating dwelling fire on Rockport Road, about a block from Brierneck Ave. just a couple weeks ago. And the Gloucester Times noted that the fire was harder to fight because of the narrow drive leading to the house. With a combination of wind gust conditions and close proximities, house fires can spread fast!

This issue would be best managed by addressing the offending abutters to your private way. The City has limited legal authority in this matter.

In recourse, you could try writing to the State Fire Marshall’s Office. I would.

And so if my house catches on fire, or someone gets hit by a car, then I suppose that I should probably knock on the abutters door and notify them as such. This is indeed a public safety issue that needs to be addressed.

I think that it is more than reasonable for the complainant to be able to ask the State Fire Marshall if 527 CMR 10.00: Fire Prevention General Provisions for fire lane requirements applies here. Thanks. Suppressing my suggestion seems like abetting a party that is possibly in breach of Life and Fire Safety Codes. I will call the mayor’s office about the supression of potentially life saving information. Not in the public interest at all.

My apologies for posting again. Obviously the road is not a bonafide “fire lane” but it is a "fire apparatus access road", even though it is a private road. And there is probably some kind of code governing the minimum width, but you could look that up yourself or call the State FM Office. I have found the State Fire Marshall’s Office to be extremely well versed and interested in code issues like this. If not enforceable, what’s the point of even having Fire Codes anyway?

I notified the building inspector of these issues and they have responded telling me that it is a civil action that I need to address, and not an issue of public safety. I do not agree, and was disappointed in their response. Abutters do have certain rights to a private road, but they do not have the right to impede my access nor construct anything in the road that may serve as a deterrent or safety hazard. The State FM Office is indeed interested in examining this issue, and not just in Gloucester, but in many other towns across the state.
