Candace, I reported this several weeks ago, and got a notification today that the issue had been closed. I do hope it will be taken care of soon.

As of this morning, the junk was still there. At times the city said this is private property but this is incorrect. Although Wind River parking lot is private property the border and road at the end of the Encinal Basin is not. I've had to point this out to them in order for the junk to be picked up. ( there is the remains of a faint double yellow PUBLIC line in the road that borders the Encinal Basin).

The City is notifying the property owner to have the illegal dumping cleaned up.

Although the parking lot to Wind River is private property this section, as previously been determined on this site, is NOT private property. It is a short portion of a road that is right behind the base of the Encinal basin that has a low silver fence and public notices . Also, This area of the road has (faded) double yellow lines in it and will be used as a road way again once the new housing and Jean Sweeney Park are completed.

While there may be an old road where the dumping occured, County parcel maps show the area in question as being owned by Wind River.

When there is repeated dumping on the same private property, why is Code Enforcement failing to notify the property owner in every case? Why does code enforcement just transfer this sort of issue to Public Works, to have the dumped items picked up by ACI, presumably at a cost to the city, when the property owner is responsible?
I ask this question because a dozen other residents have asked this question, over and over again on SeeClickFix, when repeat illegal dumping happens on the same properties by the same tenants/owners, and code enforcement does nothing. Residents want the illegal dumping stopped at the source. Only code enforcement is empowered to do that.

Code Enforcement has jurisdiction over violations, of the Alameda Municipal Code, which occur on private property. Public Works has jurisdiction if it is public land. In this case it was alleged the dumping was on land that was "not private property". Therefore, the case was transferred to Public Works. Further review determined the dumping took place on private property (see map above). Subsequently the property owner is being notified to clean up his site.

I walked past this location today, and the bulky items were no longer there. There's still a fair amount of "small" items of litter, but at least the furniture is gone. Hooray!
