The police were called, but didn't enforce the ordinance. Are the officers trained to know patios have to close at 11:00? If not, why? If so, why are they not enforcing it?

The police or SOMEONE with authority in codes or some City Dept need to pay attention. The word is that the police do not really care. They are not required to live in Albany and dont seem to like it very much. Very sad. We need to hear back why the police do not enforce here on Clickfix. It matters.

My experience (next door) is that the city seems to try to avoid doing anything. Police say it’s a code violation, and Building & Codes tells you to call the police. SOMEONE (!!!) at the TOP needs to knock a few heads.

I live on Dana and have been putting up with the Lionheart for years. Our beat officer Joe Lynch does nothing. City favors business over residents. Im at my breaking point.. I’m getting ready to sell my house and move out of this awful city.

Ongoing violations are reported about the Lark Tavern and the Lionheart, but there is no consistent or lasting action, including from the neighborhood associations, Common Council, the city, the authorities, etc. We are over taxed, but can't get help for serious quality of life and safety issues. With the lack of accountability is coming an increase in boldness and verbal altercations and more harassing and violent behavior inside and outside many of the area establishments (even outside Bombers lately) spilling onto our side streets and in front of people's houses all hours of the night and not only weekends. Something has definitely changed in regards to escalating violence and disregard for others and it's getting worse. So what do we do rather than be victimized and ignored? Contact the media?

Thank you for your submission to See Click Fix. The officer investigated the noise complaint in reference to the patio being open after hours. The bar wasn't serving patrons on the patio. The people congregating the patio area were smokers.

Why were patrons allowed to congregate on the patio if the patio was closed after 11pm?

This is inaccurate. These were not smokers and no officer showed up at the time to be able to make this assessment. The patio was fully open with patrons drinking alcohol just as it still was after 1:00am again this morning.

Well, that's a lot of noise for a group of people smoking. I'm east of the intersection and I can hear these "smokers" from here. Sometimes, they're smoking so loudly I can hear them with my windows shut.

Whether the bar was serving patrons on the patio or serving patrons at the bar who then went to the patio is a distinction without a difference. The issue is the noise after a certain time of night.

So, people are allowed to make excessive noise at 1am as long as they are smoking?

The Officer that handled the call attempted to call the complainant back inref to the call but there was no contact information in the call ticket.

Multiple complainants on multiple streets are expressing on this comment thread, and on other SeeClickFix complaints about the Lionheart and Lark Tavern, that there is not police presence or accountability after 11:00 PM. Please address the concerns above about APD being under the erroneous impression that people can loudly congregate on patios and streets, sometimes up to 30-40 people, the majority with alcoholic beverages, until 4:00 AM closing time as long as the establishment tells APD the people are smoking. This is what's happening and it's a clear violation. There is no smoking exemption for the 11:00 PM patio closing. Please do not close this complaint before confirming here that officers, inspectors, and the establishments have been informed of this. Thank you.

The Lionheart was advised by the officer that evening, and checked since then in reference to your complaint about the patio being open after 11pm. In the future if you feel that there is loud and unusual noise please call police dispatch at 438-4000 and a Police unit will be dispatched to handle the call.
