We are filing a formal complaint with the Bureau of Highways seeking the removal of the illegal fence that was constructed in the County Right of Way at 3202 Florence Rd. The owners also continued the fence in the County Right of Way across the area where the flag lot for 3206 Florence Rd meets Florence cutting off our required connection to Florence Rd.

The original fence was a non conforming use around a farm field (around the year 1977) prior to the farm being subdivided. The original fence was removed by the owners of 3202 Florence Rd., last September, without seeking county approval and then a new fence was built in the County Right Of Way on County Land. We are seeking to either have the County remove the fence from the Right of Way or to have the County force the owners of 3202 Florence Rd to remove the fence they illegally constructed.
Once the old fence (1977) was removed in its entirety it was no longer allowed to be there (Per 129.0.C Non Conforming Use states “Nothing contained herein shall be deemed to permit the intentional demolition and reconstruction of any building containing a nonconforming use by owner or occupant.”). For reference the County’s Survey team located the property corners for 3202 Florence Rd which clearly show this to be an illegal structure. We await the County’s response to correcting this issue.
