ORDINANCE 17.42.23 Passed in Summer of 2023 AMENDING CHAPTER 313 (SOLID WASTE) OF THE CODE OF THE CITY OF ALBANY CREATING AN INCREASING FEE SCALE AND MODIFYING THE NOTICE REQUIREMENT FOR REPEAT VIOLATIONS OF TRASH AND LITTER PROVISIONS

Thank you for using this application to report an issue to the City of Albany. According to city code (§313-47), property owners are responsible for keeping their properties maintained with regards to lawn and litter. DGS staff will inspect the property for any violations. If violations are found, the property owner will be notified and given ten business days to rectify any violations. After ten business days, DGS will re-inspect the property for compliance. If the property is still in violation, DGS will schedule a cleanup of the property and the owner will be billed. Please note that due to the high volume, these requests may take up to two weeks or more for DGS to clean.

§ 313-49 Penalties for offenses.

A. Any natural person who engages in unlawful conduct as defined in this article shall be
punishable by a fine of $100 for the first offense. The fine for each subsequent offense
shall increase by $250 but may not exceed $20,000.

OK, so perhaps this issue was reported under previous tickets, but what is the city actually doing about this gross violation by the property owners??? This matter was reported under ticket 15996043 on 2/3/24 and DGS stated on 2/5/24 that they would inspect the property for violations. Now we have this current ticket on 2/10/24 and DGS stated the same thing on 2/12/24. Maybe the reason why there are duplicate tickets is because the city isn't really doing anything? Put your money where your mouth is... ENFORCE YOUR OWN LAWS AND CODES! Why are these property owners getting a pass?
