The same thing happens in MAVERICK ST the fireworks when on ,all the way until 1am .

People were settting off fireworks in the vacinity of the Revere Beach Parkway too. Safety issue, no rain, could start a fire!

Unfortunately, the reality is that there is little the Police Dept. can do, in Chelsea or any other City, to eliminate fireworks on or around the 4th of July. They are so ubiquitous on the evenings of July 3 and July 4 that the Police can't possibly respond to every call. At best, they prioritize and respond to the most outrageous displays and try to get them under control.

While what you say is true, what is of particular annoyance is the fact that people are staging their own fireworks displays IN PLAIN SIGHT OF THE POLICE STATION. I fail to understand why CPD can't be bothered to step outside the building and ticket such flagrant violations.

Fines should be enforced and perhaps leaflets distributed informing people of the law and how distressing it can be for those with PTSD and animals.

Here is the wrinkle on fines and enforcement in general. The Police cannot just issue fines for this violation. The state statute provides instead that the fine for this violation (which is between $10 and $100 max) requires a conviction. So, all the Police can do is take away the fireworks and then, if they were so inclined, prepare an application for a criminal complaint and hope that the Court Magistrate would issue a summons for the violator to show up in court on the criminal complaint. (After re-reading the statute last night, I realized it doesn't allow for arrest for possession of fireworks. Only issuance of a summons after application for Criminal Complaint.) I can assure you that very few Clerk Magistrates would even be willing to issue the Summons, even if the Police were inclined to invest the time and energy to fill out criminal complaint applications for a matter where the maximum penalty is a $100.00 fine. So, for most Police Depts., this violation just isn't worth the enforcement efforts. That is why most just focus on controlling the worst of displays. I suppose you could have a local Ordinance, passed by the City Council, which includes a $300 civil fine. Chelsea does not have one. All Chelsea has is a Noise violation, which might be applicable here, but first offense is only a warning, so that wouldn't provide much help in these circumstance. Sorry for the bad news.

I appreciate the procedural nuances you describe and the practical challenges to having CPD respond to each and every complaint. However, from a messaging perspective, it troubles me to hear that the message being sent to the community is essentially: "activity X is illegal; however, if there are enough of you doing it, we're not going to be able to do anything about it." Given that the July 4 holiday is a predictable day of the year when noise and fireworks activities occur, perhaps there is some advance planning that can be done, whether it is additional CPD personnel on duty or otherwise. I agree with Anli, you've basically given the entire community the go ahead with setting off all the fireworks they want (and probably other noise related complaints) without repercussions because it's too much effort to deal with.
