Description
This sign is not allowed by state law. Since the city put it there, it is a traffic department issue not a police issue.
All city residents and park visitors have the right to use 58th Ave to make the safer right hand turn on 1st street instead of the unprotected left hand turn onto busy 62nd Ave.
See Advisory Legal Opinion - AGO 2004-13
"Is a municipality authorized by Chapter 316, Florida Statutes, to erect signs that state "No Thru Street" on local, platted, municipally maintained roads for the purpose of preventing the use of the road by motorists other than those who reside on the street or who are invitees of persons who reside on the street?"
"nothing in Chapter 316, Florida Statutes, or elsewhere authorizes the city to limit the right of the public to use such roadways for the exclusive benefit of the home owners in the area and their invitees."

Thank you for bringing this sign to my attention. I will look into the background of why it was installed and if necessary, have it removed.

The Local Traffic Only sign at 58th Avenue NE and Lee Street NE along with the other one at 58th Avenue NE and Foch Street NE will be removed because that is not the correct use of this sign. Per Section 6F.09 of the Manual on Uniform Traffic Control Devices (MUTCD), a Local Traffic Only sign is to be used in conjunction with road closures but where local road users can still use the closed road to get to their point of destination. For example, a road is closed due to construction, but people still need to get to their house on that road. They can still use the road, but everyone else has to detour.
Sincerely,
Brian Pessaro
