A resident at Kimball Court Apartments has called 3 times since the week of May 27th. The first call came in on Wednesday May 29th in which she was complaining that the neighbors the floor above her and below her are smoking inside their apartments and outside on their balconies causing smoke to engulf her apartment. The woman was informed that they are allowed to smoke in their own apartments and even better if they do it outside and that they are in no violation of the housing code. The same woman called back the week of June 3rd. On June 4th she was now complaining that the neighbors above her on the 3rd floor are spraying toxic fumes into her apartment windows and that she has called the fire department and they have not been able to help her. She stated in her message that she cannot breathe when they do this and that she wants something done about it and she continued to comment on them smoking cigarettes all the time on their own premises. She was again told that they are in no violation of the housing code with smoking inside or on the balconies of their own apartments. The same woman called back yesterday 6/17/2013 to ask when the heating season is. I (Meghan) told her that it runs from September 15th - June 15th. She then told me that her neighbors below her are turning their heat up so high that they have to stay out on their balcony for up to 12 hours. She believes they are trying to bake her out of the apartment or get it so she will turn her air conditioning on so that she will cool down their friends on the top floor above her. Again she was told that unfortunately they are not in violation of the housing code and they can turn their heat up as high as they want. She also went on to say she was going to call the fire department because the neighbors downstairs have a gas grill inside the department. I (Meghan) told her she has the right to call them if she would like. I (Meghan) believe the issue is an ongoing dispute that she has with her neighbors above and below her.
