Almost every evening, weather permitting, residents on Newkirk Ave between Flatbush Ave and E 23rd St are blasting music either in front of their building or from a parked vehicle . The police department doesn't usually respond to noise complaints filed around 8 or 9 pm until midnight or much later. The noise and the music from Newkirk can be heard and the base can be felt at my home on Stephens Ct. This evening, I filed a noise complaint # C1-1-1588920771 at 7:32 pm and received an unusually prompt response at 8:47 pm stating that "The Police Department responded to the complaint and with the information available observed no evidence of the violation at that time". This is not true. The music did not stop nor was it lowered. I tried to contact the 67th precinct at (718) 287-3211, but the operator does not pick up the phone. I am not sure what to do, because clearly the police department appears to be ignoring this quality of life issue. And generally, the police patrolling this area do not engage the residents regarding noise unless a complaint has been filed, even though their behavior is in clear violation of the NYC Noise Code. Police don't enforce giving tickets for smoking weed on the street either. Most of the people blasting music from cars on East 23rd Street don't live there. They come to visit their gang buddies and buy weed.
They can smoke weed and blast music and go home whenever THEY decide. The residents and home owners pay the taxes for the abuse that they endure. Chicken bones and chinese food, loud music, smoking weed.... Easst 23rd is a free for all. Cops do nothing no matter what time you call.

Sec. 24-218 General Prohibitions:
(a) No person shall make, continue or cause or permit to be made or continued any unreasonable noise.
(b) Unreasonable noise shall include but shall not be limited to sound, attributable to any device, that exceeds the following prohibited noise levels:
(1) Sound, other than impulsive sound, attributable to the source, measured at a level of 7 dB or more above the ambient sound level at of after 10:00 pm and before 7:00 am, as measured at any point withing the receiving property or as measured at a distance of 15 feet or more from the source on a public right-of-way.
(2) Sound, other than impulsive sound, attributable to the source, measured at a level of 10 dB or more above the ambient sound level at of after 7:00 am and before 10:00 pm, as measured at any point withing the receiving property or as measured at a distance of 15 feet or more from the source on a public right-of-way.
- So, there is nothing in the code that specifies that noise complaints can only be filed after 11 pm. And furthermore, it provides guidelines for illegal noise levels between 7 am and 10 pm. The noise that I am complaining about can be heard inside of my house on the next street over. My home is way more than 15 feet away from the source of the noise and the noise level is well above 10 decibels over the ambient sound level. Therefore, the noise level is in violation of the NYC Noise Code during the day time hours before 11 pm.
- In addition, here is Sec. 24-233 Personal Audio Devices:
(a) No person shall operate or use or cause to be operated or used any personal audio device in such a manner as to create an unreasonable noise.
(b) For the purposes of this section unreasonable noise shall include but shall not be limited to:
(1) the operation or use of a personal audio device on or in any public right-of-way so that sound emanating from such device is plainly audible to another individual at a distance of 25 feet or more from the source
(2) the operation or use of a personal audio device from on or inside a motor vehicle, whether moving, parked, stopped or standing, on or in any public right-of-way so that the sound emanating from such vehicle is plainly audible to another individual outside of such motor vehicle at a distance of 25 feet or more from the source.
- So, my house is definitely more than 25 feet from Newkirk Ave, since its located on Stephens Ct. Residents on Newkirk Ave blast music on public sidewalks and from parked vehicles. And the music is so loud that I can hear it clearly inside of my home. Once again, there is absolutely no language in the NYC Noise Code that specifies that noise complaints can only be filed after 11 pm and it clearly restricts unreasonable noise during all hours of the day.
- I would like for the Brooklyn Community Board to point to a section in the NYC Noise Code that states that noise complaints for loud music can only be filed after 11 pm. That the loud/blasting music is legal before 11 pm. That the police department should not enforce the NYC Noise Code before 11 pm. And that I and my neighbors should be subjected to unreasonable noise, which is illegal in accordance to the NYC Noise Code, for hours except when its after 11 pm. Thanks!

Here's a thought, maybe if you kept your dogs on-leash in on-leash areas of Prospect Park you wouldn't have such bad quality-of-life kharma.
